BECOMING A FLORIDA RESIDENT
Once an individual decides to change his/her State of domicile, he/she should consider taking as many of the steps listed in the checklist below as possible to further evidence his/her intention to make the new State his/her primary home. The changes should be effected near-simultaneously with the change in domicile. State taxing authorities are likely to discount those changes that take place a substantial period of time prior to or after the purported date of the change of domicile.
Of course, common sense should prevail in considering the checklist. The list is offered as an illustration only, and even full compliance with the list will not guarantee that a change in domicile will be respected. Each individual's activities, patterns and contacts in both the old State and the new State will be unique, and cannot all be covered in a generalized checklist.
In layman's terms, domicile is essentially the place that "one calls home." State taxing authorities will look at the totality of an individual's activities, patterns and contacts to try and determine which State appears to be most significant to the taxpayer.
This is especially true if changing domicile. In the absence of conduct that shows a clear and definite intent to change domicile, the prior State of domicile will claim that there has not been, in fact, any change in domicile. Accordingly, taxpayers should periodically review their contacts both in the old State and the new State to see how their activities, patterns and contacts would appear to taxing authorities in the old State.
Homestead, Exemption Application. File for homestead exemption at the Properly Appraiser's Office of Palm Beach County. Florida. The South County Service Center of the Property Appraiser's Office is located at 501 South Congress Avenue, Suite 150, Delray Beach, Florida 33445. Phone: (561) 276-1250. Hours of Operation are Monday through Friday. 8:30 a.m. to 5:00 p.m. The Property Appraiser's website is listed on Exhibit A. A homestead exemption application and instructions can be accessed through the Property Appraiser's website.
Declaration of Domicile. File a Declaration of Domicile in the Office of the Clerk & Comptroller of Palm Beach County. You must bring some form of legal identification. Acceptable forms of identification include, but are not limited to an identification card or driver's license issued by the Department of Highway Safety and Motor Vehicles and a passport issued by the Department of State of the United States. You may leave the Declaration of Domicile at the South County Courthouse, 200 West Atlantic Avenue, Delray Beach, Florida 33445. Phone: 561-355-2991. Hours of Operation are Monday through Friday. 8:00 a.m. to 5:00 p.m. The Declaration of Domicile will be forwarded to the Central County Courthouse in West Palm Beach where all domicile declarations are formally filed. There will be a small recording fee owed at the time of the submission of the Declaration of Domicile. Florida Driver's License. Obtain a Florida driver's license and relinquish your old State of residence driver's license. Change Your Address on Bills. Pick up change of address forms at the local post office branch in Florida. Change your address on utility bills, phone bills, cable bills, credit card bills, other bills and newspaper and magazine subscriptions to your new Florida address.
File Tax Returns in Florida.
File Federal Income Tax Return with the IRS Center corresponding to Florida: Department of the Treasury, Internal Revenue Service Center Atlanta, GA 39901-0102.
File resident tax returns in Florida and pay taxes there. Contact your accountant, attorney or financial advisor for information on taxes applicable to Florida residents. File a nonresident, rather than a resident, income tax return in your current State of residence provided there is no current State of residence based income. Have your accountant contact your current State of residence Department of Revenue Services to remove you from your current State of residence income tax rolls.
Change Automobile and Boat Registrations. Reregister automobiles and boats, if any in Florida and relinquish registrations in your current state of residence. Bring title, registration and proof of insurance to the Palm Beach County Tax Collector’s Delray Beach Branch Office, 501 South Congress Avenue, Delray Beach, Florida 33445. Change Voter Registration Location. Register to vote in Florida and vote in each election. To register to vote in Delray Beach, Florida go to the Palm Beach County Supervisors of Elections Southeast Branch Office located at 345 South Congress Avenue, Room #103, Delray Beach. Florida 33445, Phone: (561) 276-1226. You may access an online voter registration form at the Palm Beach County Supervisor of Elections website whose address is listed on Exhibit A.
Furnish your Florida home more extensively than your prior State of domicile/residence home.
Transfer works of art, expensive furniture and heirlooms to your Florida residence.
Transfer safe deposit box contents to Florida.
Open a bank account in Florida.
Transfer securities to a brokerage account opened in Florida.
Refer to Florida residence in all trusts and other legal documents.
Associate with entities of the new state
Obtain doctors and dentists in Florida.
Join country or social clubs in Florida.
Affiliate with a religious groups in Florida.
Affiliate with Florida organizations and consider reduction in level of commitment with your current State of residence organizations.
Where feasible, have family gatherings and social activities centered in Florida rather than your current State of residence.
Consider acquiring cemetery plots in Florida.
Keep track of travel to and from Florida (such as credit card charges for travel, etc.) to provide evidence of the amount of time spending in Florida.
